Professional negligence claim 'could be alternative'

Suing for professional negligence is one of two options if you feel your property has been missold to you, according to one homes expert.

In the Daily Telegraph this week, a reader asks the property expert David Fleming whether he should take legal action after he received a £1,350 gas bill after six months in his property.

The converted Victorian maisonette was given a high energy efficiency rating, meaning that the estimated annual cost of running of it was £421.

Mr Fleming said that cases of professional negligence around misleading energy performance certificates (EPCs) may increase in the future.

However, EPC terms and conditions often exclude or restrict the liability to the seller who commissioned the report, the expert claims.

This can create a dilemma for property owners who have suffered professional negligence.

He cites one case where a bank was sued for giving a negligent reference.

It may be a precedent for the future for future cases arising around the compulsory EPCs.
