Professional negligence claim by family of NHS death man

The family of a 77-year-old man who died after doctors failed to diagnose his stomach ulcer are planning to make a claim against the NHS Trust they deem responsible for the tragedy.

Barry Shillito fell ill in January this year, but was refused a home visit by the local medical centre, the Hull Daily Mail has reported.

He was instead told to take strong painkillers, after a telephone diagnosis of flu.

The man died two days later due to internal bleeding on his way to the hospital.

His granddaughter Wendy Sewell has said that the family will be making a claim for clinical negligence against Orchard 2000 Medical Centre.

"We are considering legal action, that's our next step. We don't want anyone else to have to suffer in this way," she remarked.


Paul Stott, assistant deputy coroner at his inquest, said that the wrong diagnosis and a subsequent delay in treatment for his ulcer may have been a factor in Mr Shillito's death.
