Employment disputes could become more common with higher incidences of brain scanning at work.
Research published by the University of California last week highlighted the potential role of magnetic resonance imaging in job interviews.
Scientists found that patterns in the brains of 40 volunteers wanting career guidance correlated with different kinds of ability.
These included speed of reasoning, spatial awareness, memory and general intelligence.
However, workers whose performance fails to live to up to their scans may find themselves in employment disputes.
In addition, some critics believe that it could allow employers access to too much personal information.
Alex Deane, the director of Big Brother, commented: "This is a disgraceful idea.
"People should not have to submit to any form of body scan before they get the job.
"Interviews are intrusive enough to start with without brain scans. It's allowing companies to go too far with access to our information. If we allow this, where will scans and intrusions stop?"
