Commercial disputes could become more common with the establishment of the one-in, one-out system of regulation proposed by the coalition.
Business secretary Vince Cable announced this week that domestic legislation affecting small businesses will be tackled first.
However, this could give rise to commercial disputes as more small companies find themselves falling astray of business regulations.
The government will also tackle the issue of "gold plating" which it believes places UK firms at a competitive disadvantage with other Europe-based businesses.
Each department will have to stick to "Principles of Regulation", a new code by which they can measure the impact of any potential new legislation on individuals, communities and businesses.
On the move, Mr Cable said: "By ensuring regulation becomes a last resort, we will create an environment that frees business from the burden of red tape, helping to create the right conditions for recovery and growth in the UK economy."
After the application of the red tape system to small businesses, it will be applied across the economy.
